Overview

Since 2015, the 10th Judicial District Court has maintained a system of contract attorneys in Child in Need of Care (CINC) cases in an effort to both stabilize cost and provide efficient and expert legal counsel. The 10th Judicial District Court offers both full and half CINC contracts. A full contract pays $44,000 annually and is intended to constitute a half-time law practice. A half contract pays $22,000 annually and is intended to constitute a quarter-time law practice. Attorneys shall be assigned to act as both parent attorney and Guardian ad Litem and shall not have an expectation to have a caseload weighted toward either assignment.

The 10th Judicial District Court maintains one managing attorney who is tasked with case assignment and caseload monitoring. The managing attorney shall be responsible to ensure that cases are assigned pursuant to half or full contract status. Additionally, the managing attorney shall ensure docket coverage and be the primary point-of-contact for the District Court.

Job Description

Appeals are compensated at a flat fee rate of $1,900. Requests for additional compensation under exceptional circumstances may be made by motion, to be reviewed by a District Court judge who is not being appealed. The contract trial attorney must protect a litigant’s right to appeal even if he/she does not plan to handle the appeal. A contract attorney may request that the court appoint alternate counsel.

Selection of contract attorneys shall be made by the Chief Judge, Court Administrator, Judge Sloan, Judge Schoenig, and Judge Ashford. Interviews may be necessary. Prior experience with CINC cases, while not mandatory, is beneficial.

Attorneys are independent contractors, subject only to Supreme Court Rule 226, the Rules Relating to Discipline of Attorneys, and Supreme Court Rule 110A relating to Guardians ad Litem. Nonetheless, contract attorney performance shall be closely monitored by the managing attorney and Judge Sloan. The District Court reserves the right to modify, adjust or terminate contracts as necessitated by budgetary or caseload changes.

Job Requirements

By submitting this application to provide legal services as described in the Offer of Contract for Services, the undersigned attorney hereby represents and contractually agrees, if selected:

1.That he or she will accept appointments from the 10th Judicial District Courts forlegal representation of children or indigent parents subject to actions under the Kansas Code for Care of Children.

2.That he or she will be subject to and abide by Supreme Court Rule 226, the RulesRelating to Discipline of Attorneys and Supreme Court Rule 110A relating to Guardian ad litem’s.

3.That he or she has not been disciplined by the Disciplinary Administrator or KansasSupreme Court within the past 5 years and does not have any disciplinary complaints or investigations pending, except as described in an addendum to theattached resume.

4.That he or she does, or will, carry professional liability insurance with minimumcoverage of $100,000 per claim and will provide proof of such coverage to the Supreme Court attorney registration department and the 10th Judicial DistrictCourts.
